Welcome to shopartuvate.com (the "Site"), operated by MNC Commerce LLC dba Malkiawear ("Malkiawear," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site and your purchase of our print-on-demand apparel. By visiting the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Access and Account
You may browse the Site and place orders as a guest or by creating an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. We may suspend or terminate access if we believe you have violated these Terms. You must be at least the age of majority in your state of residence to make a purchase.
Our Products
Malkiawear sells made-to-order, print-on-demand women's apparel, including African-print, Afrocentric, faith and scripture, and affirmation designs across styles such as hoodie dresses, maxi dresses, corset dresses, V-neck tees, leggings, blanket hoodies, cardigans, and pajama/sleep sets, in sizes XS–7XL. Because each item is produced specifically for your order, slight variations in color, print placement, and fit may occur. We make every effort to display product colors and details accurately, but actual appearance may vary depending on your screen.
Orders
When you place an order, you make an offer to purchase the products in your cart subject to these Terms. We reserve the right to accept, limit, or decline any order, including orders that appear fraudulent, that violate these Terms, or that exceed reasonable quantities. Once production of a made-to-order item begins, the order generally cannot be changed or canceled; please review your size and design selections carefully before checkout.
Prices and Billing
All prices are listed in U.S. dollars and are subject to change without notice. You agree to pay the price shown at checkout plus any applicable shipping charges and taxes. Payment is processed through our payment providers (such as Shopify Payments and PayPal). You represent that you are authorized to use the payment method you provide.
Shipping and Delivery
We currently ship within the United States only. Orders typically take approximately 10–14 business days for combined processing/production and delivery. Shipping is a flat $4.99 for the first item plus $3.00 for each additional item, and shipping is free on orders over $150. Delivery timeframes are estimates and are not guaranteed; delays caused by carriers, production partners, or events outside our control are not the responsibility of Malkiawear. Returns and Refunds
We accept returns within 30 days of delivery, subject to the conditions described in our Refund Policy. Because items are made to order, certain products may have additional return conditions. Please review our Refund Policy before requesting a return.
Intellectual Property
All content on the Site — including designs, artwork, logos, text, graphics, images, and the Malkiawear name and branding — is owned by or licensed to MNC Commerce LLC dba Malkiawear and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any Site content or product design without our prior written permission.
Optional Tools
The Site may provide access to third-party tools and features that we neither monitor nor control. Any use of such optional tools is entirely at your own risk, and you should review the terms and policies of the third-party providers. We provide these tools "as is" without any warranties.
Third-Party Links
The Site may contain links to third-party websites or resources that are not owned or controlled by us. We are not responsible for the content, products, or practices of any third-party sites, and your use of them is at your own risk.
Relationship with Shopify
Our Site is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products to you. Shopify provides certain payment, hosting, and data-processing services in connection with your order, subject to Shopify's own terms and policies.

You agree not to use the Site for any unlawful purpose; to violate any laws or regulations; to infringe our or others' intellectual property rights; to transmit malicious code, spam, or harmful content; to harass, abuse, or harm any person; to submit false or misleading information; to interfere with or circumvent the security or operation of the Site; or to collect or scrape data without authorization. We may terminate your access for violating any of these prohibitions.
Dispute Resolution
We want to resolve any concern quickly and fairly. First, please contact us informally at support@shopartuvate.com with a description of your concern. You and Malkiawear agree to make a good-faith effort to resolve the dispute informally within 30 to 60 days of that notice.
If the dispute is not resolved informally, you and Malkiawear agree that it will be resolved by binding individual arbitration rather than in court, except as noted below. The arbitration will be governed by the laws of the State of New Mexico, and any in-person arbitration proceedings will take place in New Mexico. You and Malkiawear each waive the right to participate in a class action or class-wide arbitration and agree that disputes will be brought only in an individual capacity. As an exception, either party may bring an individual claim in small-claims court if it qualifies. This section does not prevent either party from seeking injunctive relief to protect intellectual property rights. To the extent any dispute is not subject to arbitration, it will be brought in the state or federal courts located in New Mexico.
Termination
These Terms remain in effect until terminated by you or us. We may suspend or terminate your access to the Site at any time, with or without notice, if you breach these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
Disclaimer of Warranties
The Site and our products and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any product will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, MNC Commerce LLC dba Malkiawear and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or our products. In no event will our total liability for any claim exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless MNC Commerce LLC dba Malkiawear and its owners, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
Waiver and Entire Agreement
Our failure to enforce any right or provision of these Terms will not be a waiver of that right or provision. These Terms, together with our Privacy Policy, Refund Policy, and any other policies posted on the Site, constitute the entire agreement between you and Malkiawear regarding your use of the Site and supersede any prior agreements.
Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
Governing Law
These Terms and any separate agreements through which we provide you products or services are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict-of-law principles.

The section headings in these Terms are for convenience only and do not limit or affect the interpretation of any provision.
Messaging/SMS Terms
If you opt in to our SMS marketing program (powered by Postscript), you consent to receive recurring automated marketing text messages from Malkiawear at the phone number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and you can get help by replying HELP. Your participation is also governed by Postscript's Messaging Terms and Messaging Privacy Policy.
Changes to Terms
We may update these Terms from time to time. The most current version will always be posted on this page with an updated Effective Date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
